At Vitheka Hypothèques, getting a mortgage means trusting us with things you would not tell many people: your income, your debts, what your home is worth. This page explains plainly what we collect, why, who we pass it to, how long we keep it — and what you can require of us at any time.
01Who we are
Vitheka Hypothèques is the business of Jonathan Boily, a trainee mortgage broker affiliated with the firm Planiprêt. This policy covers the vitheka.ca website and the email, phone and in-person exchanges that follow from it.
Because mortgage brokerage is a regulated activity in Quebec, some of the information you give us is also handled by the firm we are affiliated with, as part of its own obligations. The firm then applies its own privacy practices.
02Privacy Officer
The law requires us to designate a person responsible for the protection of personal information and to publish their contact details. Address any question, any request for access or correction, and any complaint about your personal information to them.

03What we collect
We only collect what you give us yourself, by filling in one of the forms on the site or by writing to us. No form on this site is mandatory — you can always call us instead.
Contact form
- Name, phone, email
- Subject of your request
- Your mortgage renewal date
- Current financial institution
- Approximate mortgage balance
- The message you write
Pre-qualification form
Depending on the type of project you select, this form may collect:
- Project type (purchase, renewal, refinancing, debt consolidation, income property, self-employed) and timeline
- Target purchase price, available down payment, approximate value of your property
- Mortgage balance, current financial institution, amount requested
- Amount and type of debts to consolidate
- Approximate annual income, how long you have been self-employed, and whether you declare all of your income
- Your contact details and contact preferences
This information is sensitive — it describes your financial situation. We do not ask for anything we do not need to assess your file, and you may decline to answer any question: it does not stop you from talking to us.
Referral program
This form asks for your contact details and those of the person you are referring. If you give us someone else's contact details:
- you confirm that this person agrees to be contacted by us;
- we tell them, at first contact, that you referred them;
- if they ask us to delete their details, we do so immediately, no questions asked.
Technical information
Our hosting provider keeps standard connection logs (IP address, time of visit, browser type) for security and site operation. We do not use them to identify or profile you.
04Why we collect it
Every piece of information we ask for serves one of these purposes, and nothing else:
| Purpose | What it means |
|---|---|
| Getting back to you | Calling you back, answering your question, booking a meeting. |
| Assessing your file | Estimating your borrowing capacity and identifying the options open to you. |
| Shopping your financing | Presenting your file to lenders likely to make you an offer. |
| Supporting you | Following through to signing, and at your next renewal if you want us to. |
| Meeting our obligations | Keeping the records required by mortgage brokerage regulation. |
We do not sell your information to anyone. We do not rent it. We do not use it for advertising targeting.
05Your consent
By filling in a form, you consent to our using that information for the purposes described above. That consent is free and informed: you choose what you tell us, and you can withdraw it at any time by writing to us.
If we ever wanted to use your information for a purpose not listed above, we would ask you first, separately.
Withdrawing consent does not undo what was lawfully done before the withdrawal, and we may have to keep certain records to comply with regulation. We will then tell you exactly what is being kept and why.
06Who we share it with
We share your information only where necessary, and only with:
- Planiprêt, the firm we are affiliated with, as part of mortgage brokerage regulation;
- lenders and financial institutions we submit your file to — only those relevant to your project, and in order to obtain an offer on your behalf;
- our technical providers, described in the next section;
- an authority, where the law requires it.
07Processing outside Quebec
Quebec law requires us to tell you when your information leaves the province.
The site's forms are delivered to our inbox by FormSubmit, a form-handling service located in the United States. In practice: what you type into a form passes through that provider's servers before reaching our inbox. Information handled this way may therefore be subject to U.S. law.
If you would rather avoid that transit, do not use the form: call us at 581-889-3771 or email us directly at [email protected]. You will get exactly the same service.
Our web hosting and email may also rely on providers whose servers are located outside Quebec. We assess those providers before entrusting them with information, as the law requires.
08How we protect it
We take measures that are reasonable and proportionate to the sensitivity of what you entrust to us:
- the site is served over HTTPS, which encrypts what you send;
- access to files is limited to people who actually need it;
- the accounts we use are protected by distinct passwords and two-factor authentication where the service allows it;
- we do not keep financial documents in publicly shared folders.
No system is infallible. In the event of a confidentiality incident posing a risk of serious injury, we keep a register of it, notify the Commission d'accès à l'information and notify you personally, promptly.
09How long we keep it
We keep your information for as long as necessary for the purposes it was collected for, then for the period imposed on us by mortgage brokerage regulation.
- Enquiry with no follow-up (no file opened) — destroyed no later than 12 months after the last exchange.
- Brokerage file — kept for the period required by regulation, then securely destroyed.
- Contact details of a referred person who does not follow up — destroyed no later than 12 months after first contact, or immediately on request.
After those periods, the information is destroyed or anonymized.
10Your rights
Quebec law gives you concrete rights over your information. You exercise them by writing to [email protected]. We respond within 30 days.
Access
You may ask what information we hold about you, and obtain a copy of it.
Correction
If information is inaccurate, incomplete or ambiguous, you may require that it be corrected.
Withdrawal of consent and deletion
You may withdraw your consent and ask us to stop using your information, subject to what we must keep by legal obligation.
Portability
Since September 22, 2024, you may ask that the computerized information you provided to us be given to you in a structured, commonly used technological format, or transferred to a third party.
De-indexing
You may ask that the dissemination of information concerning you cease, or that any hyperlink giving access to it be de-indexed, in the cases provided for by law.
Automated decisions
We make no decision about you by automated means. Every file is reviewed by a person.
11Cookies and tracking technologies
This site uses no advertising cookies, no social media pixels and no profiling tools. It does not place a tracking cookie on your device.
If that were to change — for example if we added an audience measurement tool — the law requires us to inform you beforehand and to have such functions off by default. We would therefore ask for your consent before activating them, and this page would be updated.
12A question, a disagreement, a complaint
Write to our Privacy Officer, Jonathan Boily, at [email protected]. We will handle your request and reply in writing.
If our answer does not satisfy you, you may file a complaint with the Commission d'accès à l'information du Québec, the public body responsible for enforcing this law: cai.gouv.qc.ca.
13Changes to this policy
We may amend this policy, in particular if our tools or practices change. The effective date shown at the top of the page always indicates the current version.
Where the change is significant — a new purpose, or a new provider handling your information — we notify the people whose contact details we hold.
Version in effect: August 25, 2026.
Terms
Terms
of Use
Effective August 25, 2026
These terms govern your use of vitheka.ca. What they mostly say is this: what you read here is meant to inform you and to start a conversation — it is neither an offer of financing nor advice tailored to your situation. That advice comes later, when we talk.
01Acceptance
By browsing this site, using its tools or filling in one of its forms, you accept these terms. If you disagree with any of them, do not use the site: write to us or call us directly instead.
02Who operates this site
The site is operated by Vitheka Hypothèques, the business of Jonathan Boily, a trainee mortgage broker affiliated with the firm Planiprêt.
Mortgage brokerage is a regulated activity in Quebec. Brokerage services are provided through the firm we are affiliated with, under the rules that apply to that activity.
03What this site is — and what it isn't
The content of this site is provided for information purposes only.
Nothing on this site constitutes:
- an offer of credit or a commitment to finance you;
- a pre-approval or any guarantee of approval;
- financial, tax or legal advice tailored to your situation.
Only a lender can approve financing, and only after a full review of your file. Personalized advice assumes we have discussed your actual situation: income, debts, project, timeline.
04Calculators, scenarios and displayed rates
The calculators, scenarios and trend charts on this site produce estimates, based on the figures you enter and on simplified assumptions.
- They do not account for every fee, tax, insurance premium or lender-specific condition.
- Rates shown are indicative and may change without notice.
- A calculator result is neither an offer nor a promise of rate.
Do not make a financial decision on the strength of a number obtained here. Talk to us first.
05Forms and accuracy of information
The site's forms are there to open a file or to reach us. By filling them in, you undertake to provide accurate and complete information: a file built on rough numbers leads to recommendations that do not hold up.
Submitting a form creates no obligation — neither for you nor for us. It starts a conversation, nothing more.
No form is mandatory. You can always call us at 581-889-3771 or write to [email protected].
How we handle your information is described in the privacy policy, under the other tab on this page.
06Thank-you program
The thank-you program offers a $100 gift card to the person who refers a new client to us. The conditions:
- the person referred must be a new client, not someone we already knew;
- they must agree to be contacted — you must have their consent before giving us their contact details;
- the gift card is issued after a mortgage file is actually closed with that person, not at the moment of the referral;
- one gift card per closed file;
- the program may be changed or withdrawn at any time, with no effect on referrals already submitted.
This program is a token of appreciation, not a commission. It changes nothing about the terms offered to the person referred: their file is handled exactly like any other.
07Intellectual property
The text, photographs, illustrations, logos and graphic elements on this site belong to Vitheka Hypothèques or are used with permission. Lender and partner logos belong to their respective owners and are displayed for identification purposes.
You may browse the site, print pages for your personal use and share a link. You may not reproduce, republish or reuse this content for commercial purposes without our written permission.
08Links to other sites
The site links to third-party sites — the firm, lenders, partners, external resources. Those sites have their own terms and their own privacy practices. We exercise no control over their content and are not responsible for it.
09Availability and accuracy
We keep the site current with care, but mortgage information moves fast: rates, programs, qualification rules. We do not warrant that all content is accurate, complete and up to date at every moment.
The site may also be temporarily unavailable — maintenance, outage, updates. We do not guarantee uninterrupted access.
10Limitation of liability
To the extent permitted by law, we cannot be held liable for damages arising from:
- the use of, or inability to use, the site;
- a decision made solely on the basis of information or an estimate from the site;
- the content of a third-party site linked from here.
This limitation does not apply to what the law does not allow to be excluded, in particular in cases of gross or intentional fault.
11Changes
We may change these terms and the content of the site at any time. The effective date at the top of the page always indicates the current version. By continuing to use the site after a change, you accept the updated version.
12Governing law and language
These terms are governed by the laws applicable in Quebec. Any dispute falls under the courts of the judicial district of Quebec City, unless the law provides otherwise.
The French version of these terms is the official version. The English version is provided for the reader's convenience; in the event of a discrepancy, the French text prevails.
A question about these terms? Write to [email protected].
